I met someone that ended up sighing a fairly draconian non-compete that said they would pay his old salary for as long as they wanted to keep it in force. It was something along the lines of they got to make that choice at the time of his departure.

That's really the only fair way to do it: if you don't want me working for someone else, pay me for that [non-]work.
